On Monday, as RedState reported, President-elect Donald Trump’s legal team filed a motion with the Manhattan trial court seeking to stay the sentencing currently set to take place on Friday. Last Friday, Judge Juan Merchan set the case for sentencing just 10 days ahead of Trump’s inauguration.

Trump’s attorneys requested a stay of the sentencing to afford Trump time to pursue his appeals of the court’s ruling on the presidential immunity issue as well as on the court’s denial of his motion to dismiss based on his reelection.
NEW: Judge Merchan Rules on Trump Request to Delay Sentencing
On Monday evening, Merchan issued his ruling denying Trump’s stay request. Trump’s legal team then appealed that decision to the appellate court (in New York, the Appellate Division, First Judicial Department).
That court has now ruled on the application for stay, denying it.

In a brief, two-page order, which may be viewed in full below, the appellate court states:

After consideration of the papers submitted and the extensive oral argument, movant’s application for an interim stay is denied.
Trump’s option at this point, if he wishes to postpone the sentencing, is to appeal to the Court of Appeals (the highest court in New York). Whether that endeavor will bear fruit remains to be seen. RedState will, of course, continue to follow the story and provide updates as they become available.
