BREAKING: PA Supreme Court Stops the Steal

Election integrity scored a significant win in Pennsylvania in mid-September when the commonwealth’s Supreme Court ruled that misdated mail-in ballots should not be counted.

In the wake of the November 5th election, however, some elections officials in Pennsylvania, apparently not content with the outcome of the election (and in particular, the Senate race which saw Republican Dave McCormick narrowly defeating incumbent Democrat Bob Casey), determined that they needn’t follow the Supreme Court’s edict and would continue counting misdated ballots anyway.

Lest there remain any confusion on the part of said officials as to whether or not such continued counting is legal, the Pennsylvania Supreme Court weighed in again on Monday to make it clear that no, absolutely not, are misdated mail-in or absentee ballots to be counted.

The order, which may be viewed in full below, states in pertinent part:

The Court hereby ASSUMES its King’s Bench authority over the instant Application, see 42 Pa.C.S. § 502, only to DIRECT that all Respondents, including the Boards of Elections in Bucks County, Montgomery County, and Philadelphia County, SHALL COMPLY with the prior rulings of this Court in which we have clarified that mail-in and absentee ballots that fail to comply with the requirements of the Pennsylvania Election Code, see 25 P.S. §§ 3146.6(a), 3150.16(a), SHALL NOT BE COUNTED for purposes of the election held on November 5, 2024.

In other words, to the boards of elections who continue to violate the law: Knock it off.

MCCORMICK/CASEY RECOUNT UPDATE:

Following our latest RNC lawsuit, today the Pennsylvania Supreme Court ruled yet again that undated ballots CANNOT BE COUNTED.

No more excuses. Election officials in Bucks, Montgomery, Philadelphia, and other counties have absolutely no choice but to reject illegal ballots. We will hold them to it.

The race is already headed to a recount, given that it is within the .5 percent differential (and Casey has declined to wave the recount). 

Now, the boards of elections have been told not to count the ballots in question in no uncertain terms. Will they heed the court’s order? We’ll provide any updates as they become available.
