I wrote Wednesday about how the Daniel Penny second-degree manslaughter trial in New York City is a perversion of justice and yet another indication of the utter failure of progressive politics. There are some stories I write to bring you the news; there are others that affect me emotionally. This is one of those.

It’s wrong on every level.

On Thursday, his defense called an expert forensic pathologist to the witness stand, and he promptly destroyed George Soros-backed Manhattan District Attorney Alvin Bragg’s case:
“The chokehold did not cause the death,” Dr. Satish Chundru testified.

Chundru directly contradicted the New York City Medical Examiner’s Office, who blamed Penny for Neely’s death:
Chundru, a former Miami-area medical examiner who now runs a private practice in Texas conducting autopsies in a half-dozen counties, said that he did not believe an air choke caused Neely’s unconsciousness and, therefore, did not cause his death.
Chundru said he found the cause of death to be “the combined effects of sickle cell crisis, the schizophrenia, the struggle and restraint, and the synthetic marijuana.”
Someone schizophrenic, high on K2 and involved in a struggle can die without a chokehold being involved at all, he said. Similarly, he said, if there were no health issues and the chokehold was the only factor, Neely would not have died.

As I’ve written, the Penny case is as powerful an indictment as you’ll find against the soft-on-crime, police-hating environment progressives have pushed on us in almost every major American city.
I’m not even going to present the prosecution’s case here because, frankly, I don’t give a damn what they have to say. We know that many of the passengers on that train called Penny a hero because they said so. Jordan Neely was still alive when Penny let him go. Neely had at least 42 arrests between 2019 and 2021, and his charges included just about every type of theft you could think of—as well as three unprovoked subway assaults on women.
Yet there he was, wandering the streets and the subways.
And the 26-year-old Marine vet who served his country faithfully faces a decade and a half in prison.

Chundru flatly stated that Penny did not kill Jordan Neely:
“In your opinion, did Mr. Penny choke Mr. Neely to death in 2023?” defense lawyer Steven Raiser asked.
“No,” Dr. Chundru replied, before the defense ended its questioning.

This was powerful testimony from an expert, but Penny is not out of the woods—not by a long shot. We’re talking a Manhattan jury here—and we’ve seen how insane they can be. Penny faces up to 15 years behind bars for doing the right thing and defending his fellow New Yorkers.
Progressives don’t like folks fighting back against the insanity.
Many commenters on my last story hoped that President-elect Donald Trump would pardon him—but he can’t, because this is a state trial, not a federal one. One can only hope sanity will prevail and the persecution of this hero will come to its just conclusion—a 100 percent acquittal.
